Dispel The Myth — Waive The Lead Based Paint (LBP) Form

Waive the LBP form? No Way!! This is a Federal Law, therefore there is no discussion about this form being waived. The requirement is for all properties that pre-date 1978 to have this form completed by first, the sellers(s), then accepted by the buyer(s). The listing agent and the buyer broker agent are also required to initial and sign the form. There are NO EXCEPTIONS to the use of this form. (Note: The contract also specifies that the form MUST be on one page; counter-part is not allowed.)
We are holding one agent’s commission until we get the form signed — it has now being in excess of three years. The fines can be as high as $11,000 per line. We take the form seriously. CDH
